The Board of Public Works and Safety on Dec. 1 reduced a nuisance fine for 1367 Osprey Way to $100 and gave the homeowner 30 days to correct violations after hearing from the property owner and viewing photographic evidence.
The homeowner, Antonio, told the board the lot contains more than grass and described edible and medicinal plants on the property, his health and work constraints and a limited ability to respond immediately to city notices. "It's not just the grass," Antonio said, describing several plants and explaining why he had not cut the yard sooner.
Bruce Campbell, who brought before photos, said the city had previously issued notices and otherwise the property had been maintained in the past. Staff cited the city ordinance that defines high grass and weeds as a nuisance and described prior notices and the city’s mowing process.
Board members debated both the vegetation and a leaning fence panel. Chair noted the board’s obligation to enforce the tall-grass ordinance but also the homeowner’s circumstances. A motion to reduce the fine to $100 and allow 30 days for payment and compliance was moved and seconded; the motion passed on a recorded voice count of 2–1.
The board also directed the homeowner to keep the property in reasonable repair while completing the work, and noted that if the physical fence section was missing it should be replaced. The item closed after the board’s vote.
