The Weston City Commission on Nov. 17 passed first reading of two ordinances that revise local code on vegetation and on electric‑vehicle charging equipment placement.

City Manager Don Decker described the tree‑code amendment (section 122.03) as a clarification that returns selection of replacement swale tree species to homeowners’ associations, provided selections come from the city‑approved species list. Decker said the change removes ambiguous language in the existing ordinance to avoid inconsistent enforcement. No members of the public spoke on that item; the ordinance passed first reading by unanimous roll call.

Decker also presented an ordinance to amend sections governing electric vehicle charging stations and variances to create an administrative variance pathway (section 124.37 and related) so staff can approve requests to locate battery charging equipment at an alternate location on single‑family residences when doing so is less intrusive to neighbors. Commissioners stressed that homeowners must still pull permits, and Decker said homeowners unhappy with a staff decision could appeal to the commission. The first reading passed unanimously.

Commissioners noted many homeowners’ association documents predate widespread EV adoption and that administrative variance procedures can reduce the need for homeowners to pursue a formal variance to address unusual lot layouts. Staff will prepare final ordinance language for second reading and documentation for the administrative process.
