Staff summarized the requests: a waiver to permanently omit perimeter pathways along County Road 750 South and Fayette Road (staff opposed); a deferral of pathway construction (staff supported given rural context); a waiver of the bonding requirement if the deferral were granted (staff opposed); and a waiver of fire‑protection flow requirements (staff supported) because the site cannot reasonably connect to municipal water and the county health department’s well/septic rules apply.
After staff and petitioner presentations, commissioners acted on separate motions. They denied the waiver to avoid removing the Town's ability to require sidewalks in the future, approved a deferral of the perimeter pathways for the rural location, denied the waiver of performance bond when deferring pathway construction, approved the fire protection flow waiver, and then conditionally approved the minor subdivision plat (subject to TAC/DPW comments and other standard conditions).
Brian Cross, the civil engineer representing the petitioner, explained the site’s rural context, well/septic constraints and that the proposed lots meet R‑2 standards. Several commissioners emphasized the need to preserve the Town's enforcement tools and ensure bonded assurances when pathways are deferred.
Next steps: outstanding TAC/DPW comments must be resolved prior to the secondary plat recording; staff will track conditions as part of the approval package.
