The Delray Beach Planning & Zoning Board on Wednesday recommended the City Commission approve a waiver allowing Building 4 South of the Atlanta Crossing project to encroach 2.5 feet into the required 5‑foot front setback along Northeast 7th Avenue.
Susie Rodriguez, senior planner, said the waiver (file PZ182‑2025) is limited to the porte‑cochere extension, a structural pier that will anchor an aerial public art installation, and structural support for a pool deck. Rodriguez told the board the request is reviewed against the 2013 Land Development Regulations that continue to govern the unified Atlanta Crossing site under a 2017 settlement agreement.
Bryce Hall, representing the applicant, described the two‑phase project and said the request is driven by architectural proportions: “that portion of the encroachment where it meets the ground, that 2 and a half feet for approximately 8 feet, is completing the form of that arch,” he said, arguing the reduced setback is necessary to preserve the intended appearance and function of the valet drop‑off and the public experience.
Board members focused their questions on pedestrian experience and safety. Roger Cope said the element is “very supportable” and that the pier sits in the planting strip rather than on the sidewalk, reducing impact on pedestrian flow. Several members noted the project already includes an approved streetscape, wide planting zones and bicycle racks.
After discussion the board moved to recommend approval; the motion carried on roll call and the item will go to the City Commission for final action.
