The Plan Commission on Nov. 17 unanimously approved a conditional use permit to convert an existing commercial building at 4718 Hammersley Road into an adult day care center.
Planner Tim Parks told the commission staff recommended approval, saying the proposal is consistent with the applicable standards and that conditions in the staff report would address traffic and site changes. “We are recommending approval subject to the conditions in the staff report,” Parks said.
Neighbors raised concerns during the public hearing about participant capacities and parking. Christopher Miller asked whether the facility could create safety risks for nearby yards, and Eric Kellen said earlier neighborhood meetings had flagged parking and unregistered vehicles associated with another nearby site.
Architect Steve Schulfer, representing the project, said the site plan closes the Starlight Drive driveway, restripes and repairs the lot and reduces on‑site parking demand. “This is not the same facility as the other users,” Schulfer said when asked whether the operator ran the nearby facility that neighbors referenced. The operator, David Aganaki of Always Best Care Madison, confirmed the Hammersley site “is the only purpose for this site at this moment” and that he does not operate another adult day care in the vicinity.
Commissioners pressed staff and applicants about pedestrian connections and traffic mitigation. Staff said traffic engineering had not opposed a sidewalk extension request but noted the unusual geometry of connecting a sidewalk to a cul‑de‑sac and confirmed a staff condition addressing a stop sign or similar control at the driveway connection.
Commissioner Nicole Solheim moved to find the conditional use standards met; Alder Derek Field seconded. Chair Emily Ghanam called for objections to unanimous approval; there were none and the motion passed.
The approval is subject to the conditions listed in the staff report, including removal of the Starlight Drive access and traffic‑engineering conditions to mitigate cut‑through traffic and pedestrian safety.
