The Town of Danvers Planning Board on Nov. 12 approved an Approval Not Required (ANR) plan that divides 19 Valley Road (Assessor’s Map 6, Lot 8) into three parcels, two of which will be noted as nonbuildable on the recorded plan.
Connor Walsh of the law firm Glovsky & Glovsky presented the filing on behalf of Patrick D. Connors, Mary Connors Behringer and Robert D. Connors, saying, “This is really just a ANR plan to divide this property up, to include 2 separate and nonbuildable lots from the improved lot.” Walsh explained that the nonbuildable designation will accompany the recorded plan at the registry of deeds so title reviewers will see the restriction. He added that the status could only change if a future owner sought zoning relief through the Zoning Board of Appeals.
Board members questioned whether neighboring parcels could be combined to create a buildable lot and discussed R‑3 zoning thresholds cited in the discussion (examples cited in the meeting included roughly 30,000 square feet and 125 feet of frontage as buildability thresholds). Resident Bill Bradstreet asked whether a nonbuildable label is permanent; he summarized his view that “it can, at some point, change,” and Walsh reiterated that such a change would require variances and is typically difficult to obtain.
Jean Hart moved to approve the ANR plan; Michael Decoulis seconded. The board voted to approve the ANR as presented with no recorded opposition. The ANR will be recorded at the registry of deeds identifying the two smaller parcels as nonbuildable under current zoning.
