The Augusta Planning Commission voted to forward the preliminary plan development overlay for case 2025-19 (David in Ohio) to the City Council for final consideration on Dec. 1.
Staff explained the commission had reviewed the PDO on Oct. 27 and recommended adopting the preliminary PDO as the final document now so a 14-day protest period could run and the council could take up the item before year-end. "There will be a 14 day protest period after approval by the planning commission," staff said.
Developer Owen Shickley of 10 Oaks Investment, LLC told the commission his company has "a legal contract that is binding with the current owner Whitaker" and that the owner had been notified as part of the public-notification process. Shickley said financing and RHID petition approvals could push construction timing, estimating site work ‘‘roughly based on March’’ if petitions and developer agreements proceed.
Commissioners asked about owner notification and whether the rezoning hearing would precede the PDO; staff confirmed the rezoning was scheduled for Nov. 17 and the PDO for Dec. 1. After questions, a commissioner moved to approve the preliminary PDO as presented and forward the recommendation to the city council; the motion was seconded and carried by voice vote.
The commission's action sends the PDO to the City Council, where the final public hearing and any protest filings will determine whether the overlay is adopted.
