The Moffat County Board of County Commissioners voted Nov. 12 to approve the final plat for the JJ Scott Minor Subdivision, SD-25-04, after staff said the applicant recorded a quick-claim deed to resolve a structure built over a property line.
Candace Miller, planning and zoning coordinator, told the board the survey revealed a structure built over a property line and that the applicant acquired about 1.366 acres via a quick-claim deed to clean up boundaries. "A copy of the deed of that transaction has been acquired, and is in the file," Miller said. The Planning and Zoning Commission recommended approval and staff showed the plat with required utility easements.
Commissioner (name not specified) raised concerns about arithmetic discrepancies in the acreage breakdown. The parcel being divided was listed as 32.35 acres, with four proposed lots of roughly 5.079, 5.01, 5.01 and 19.435 acres. "Numbers don't lie," the commissioner said, noting that adding the components as presented produced a shortfall and asking for clarification so the permanent record would not show an incorrect total.
Miller explained that the additional 1.366-acre acquisition accounts for the difference and said she would contact the surveyor, Mike Frayer, to confirm whether corrections to the plat or cover sheet were needed before final filing. "I will reach out to Mike first thing this morning to make sure any corrections that need to be made to the plat prior to filing get done, and I will also bring that over and show you guys," she said.
No members of the public spoke during the public hearing. Commissioner (name not specified) moved to approve SD-25-04 with the requested clarification from the surveyor; Chair (name not specified) seconded and both commissioners voted aye. The board asked staff to provide an update once any corrections had been completed.
The approval is limited to the final plat as presented and conditioned on survey clarification; the applicants stated no near-term development is planned for the newly created lots. The board returned to regular session and continued with the meeting.
