The Fremont County Board of County Commissioners voted Nov. 10 to approve MS 25-001, the Sinclair Minor Subdivision, allowing the creation of a second lot at 350 Sangre De Cristo Drive in Coaldale subject to specified waivers and conditions.
Attorney Gwendolyn Allen summarized the application and said letters of support were obtained from neighboring property owners who would be affected by the existing private roadway. Planning and Zoning Director Victoria outlined required contingencies and conditions, and listed four waiver requests to the county's subdivision regulations (frontage on public street; access to a public dedicated street; sidelines of lots at right angles to a street; access standards) (transcript SEG 388–404; SEG 423–441).
Commissioner (speaker 5) moved to approve the Sinclair Minor Subdivision (MS 25-001) including the Division of Water Resources letter dated 03/05/2025 as a contingency and four conditions: a plat note requiring a drainage plan and report for Lot 1 at time of development; recordation of a declaration of easement for the 60-foot accessway on Lot 2; driveway access permit at time of development; and required topographic and soils information at the time of OWTS permitting. "I move to approve MS 25-001, the Sinclair Minor Subdivision, for a total of 2 lots at 350 Sangre De Cristo Drive in Coldale," the mover said when making the motion (transcript SEG 476–485). The motion was seconded and passed unanimously by roll call.
The approval includes the explicit requirement that the applicant demonstrate compliance with the Division of Water Resources letter before final actions proceed. No public comment was recorded at this hearing on the item and planning staff confirmed required neighboring-owner support letters were provided.
Outcome: MS 25-001 approved with waivers, conditions and contingent compliance with the Division of Water Resources letter dated 03/05/2025.
