The Jenks Planning Commission voted Nov. 6 to continue consideration of rezoning case JZ25-700 for a small parcel at 2300 West 91st Street after neighbors and planning staff identified a likely error in the lot-split legal description.
City planner Ms. Hilton told the commission the lot split approved conditionally last month resulted in one newly created lot that does not conform to the parcel's current agricultural (AG) zoning; the applicant advertised the request as RS-1 (residential single-family) but is seeking a more restrictive residential estate (RE) zoning for the smaller lot. Ms. Hilton said deeds related to the lot split will be filed only after council approves the rezoning and that staff would prefer a corrected legal description accompany the rezoning when it goes to council.
Neighbor Jane Donner, who lives south of the property, asked the commission to consider the potential for denser future development nearby, saying development patterns elsewhere had enabled much smaller lots. "That is my concern for me and my neighbors," she said.
Jentra Sorum, speaking for adjacent property owners identified as the McGraths, told the commission the lot split's legal description appears to include a private road owned by her clients. She said the surveyor, Cliff Bennett, acknowledged the error and prepared a corrected lot-split plat. Ms. Sorum said her clients have no objection to the rezoning "as long as the legal descriptions are correct."
Several commissioners said they were uncomfortable making a recommendation to city council without the corrected legal description and with the property owner not present. Staff recommended conditioning any recommendation on submission of a corrected lot-split description for council.
A commissioner made a motion to continue JZ25-700 to the commission's Dec. 4 meeting so staff can obtain a corrected plat or confirmation that the original description is correct. The motion carried by voice vote.
