The Muskego City Planning Commission on Nov. 4 recommended that the common council rezone two parcels along Enterprise Drive (South 84 West 19120 and the adjacent vacant lot) from M‑2 to a planned development district to allow an expansion of an existing building and a waiver for a 14‑foot rear setback. The commission voted in favor with one abstention.
Adam, a city staff member, told the commission the parcels remain functionally M‑2 but that a planned development district would allow a waiver to make the existing building conforming. Adam said the owner discovered the original building was constructed “a few inches too close to the northern lot line,” which makes the structure technically noncompliant and can impose limits on the amount of investment allowed under substantial‑improvement rules. He said the requested planned development is not seeking density bonuses or other waivers, only the 14‑foot rear offset so expansion may proceed without the financial restrictions tied to making an enlarged nonconforming structure.
Adam also said staff worked with the property owners and developers and that a public hearing was held at the common council level with no public comments recorded. Commissioner Bartlett announced he would abstain because "my firm is doing the work," and the motion to recommend the rezoning passed with three votes in favor and one abstention.
If the council approves the rezoning, Adam said the rezoning would be contingent on lot combination and subsequent building approvals through the usual building and site plan review processes.
The commission’s action is a recommendation to the common council; final zoning authority rests with the council.
