On Nov. 5, 2025, the City of Delray Beach special magistrate assessed a $3,500 lien on the property at 126 Seabreeze Avenue for failure to pay a one‑time erosion‑control fine ordered July 28, 2025.
Code officer Latoya Thompson told the magistrate the fine was originally assessed for an irreversible erosion and sediment control violation and remained unpaid. Thompson said the magistrate had previously ordered a one‑time fine of $3,500 to be paid within 30 days and that city records show the fine has not been paid. The city introduced photographs from the initial hearing and a noncompliance notice posted on the property.
"I checked all city records and confirmed that the fine has not been paid," Thompson testified when asked by the magistrate to confirm payment status. The magistrate assessed a lien in the amount of $3,500 against the property and the named owner for failure to pay the previously ordered fine.
The lien was entered based on the evidence introduced at the hearing, the prior magistrate order and city staff's recommendation. The record shows a notice of noncompliance was mailed and posted and that an inspection documented the unpaid fine as of Sept. 24, 2025; the lien was assessed at the Nov. 5 hearing.
The magistrate's action places a municipal lien on the property to secure collection of the outstanding $3,500 fine. The city may proceed with collection under its ordinances if the lien is not resolved, including placement on the property tax roll or other enforcement measures per city procedures.
