At a Nov. 5 Charlotte County Code Enforcement hearing, the magistrate continued the septic‑compliance matter for the property at 8011 Cleveland Drive after the respondent provided pump‑out invoices and a contractor form while the Department of Health reported no record in the database available to the county officer.
The county’s code compliance officer said the case first came before the magistrate on June 4, 2025 and that a reinspection on Sept. 16, 2025 still showed the property not in compliance with the county’s five‑year pump‑out and inspection ordinance. The officer indicated the county could not find a permit renewal or a pump‑out record in the database it checks.
Alex Trammell, environmental supervisor for the Charlotte County Department of Health, testified he did not see pump‑out records in the database he has access to. The respondent’s family representative and the property owner said the septic contractor, Elrod Septic, submitted the April 15 pump‑out records and produced an invoice and a contractor certification form for the file. The documentary submission was admitted as Exhibit A.
Given the conflicting records between contractor documentation and the county/health databases, the magistrate continued the case to Dec. 4, 2025 to allow the contractor or the health department to confirm electronic submission and to permit the owner to resolve any outstanding permit/fee items. The magistrate noted that if the owner demonstrates the system passed inspection and the permitting fee is finalized, the county’s remaining concern will be resolved.
