Staff explained that an earlier public hearing had resulted in no action and that an attorney opinion concluded the 30-day automatic approval ('shot clock') does not apply to replats, requiring a new public hearing before the court may act.
Kyle Verla, representing the developer, said the applicant requested the matter be tabled to Dec. 8 to allow time to meet with adjacent residents, engineering staff and the fire marshal to explore options other than adding a second point of access. One adjacent landowner had submitted a letter opposing the replat; staff reported no other resident comments had been received.
Following questions about legal authority and notice requirements, commissioners agreed it was prudent to hold the item to allow the developer to work with neighbors and staff. Staff advised that any future date will require posting 30 days in advance so the public is notified. No vote to approve or deny occurred; the court did not take final action and will repost the item if and when the applicant requests a return hearing.
