The Jackson County Board of Adjustment on Sept. 22, 2025 approved an extension of a previously granted special exception to setback rules for Doug and Theresa Waller, moving the approval’s expiration to June 1, 2026.
The extension applies to docket number 24-13, a special exception originally granted in the prior year to allow reduced setbacks for a residential structure. Doug Waller, the applicant, told the board that exterior walls and roof sheathing are in place, windows and doors are on site and he hopes to have heating, cooling and electrical work underway once the roof is sealed. "We hope to make move in by October," Waller said. He also said the house is intended for his mother and father-in-law to move back to.
Board members discussed the applicant’s timeline and construction progress during the public hearing. Waller said he has been doing much of the work himself and that he is waiting on contractors (he named Kevin Mortemont for garage work and referenced Midwest Steel for measurements) to complete tasks. He said he did not yet have other county permits in place.
During discussion the board considered a May 1 deadline but ultimately a member moved to set the extension to June 1, 2026; the motion and second were recorded and the board voted in favor. The meeting record does not identify who made the motion or provide a roll-call tally; the board’s announcement of the outcome was oral and recorded as "all those in favor, say aye." The public hearing was closed before the motion to set the new expiration date.
Board members and an unidentified commenter also discussed what exterior features count toward setback measurements (for example, eaves/downspouts). The applicant noted that the driveway will not be poured until next year and that interior work can continue once the structure is heated. The board did not adopt additional conditions on the extension during the recorded discussion.
The board did not specify a vote tally in the transcript. The extension moves the special-exception approval’s effective deadline to June 1, 2026; if construction or permitting falls behind, the applicant indicated he expects to return to the board if additional time is needed.
The Jackson County Board of Adjustment meets next on Oct. 27; no additional hearings related to this docket were listed on the Sept. 22 meeting agenda as recorded in the transcript.
