General Counsel John updated the board Sept. 25 that the Technical Dispute Review Board (TDRB) held its quarterly meeting and viewed portions of the project to better understand issues should disputes arise. The authority requested that the next two TDRB meetings be virtual to save costs.
John also reported the parties implementing the settlement agreement have closed all noncompliance points identified earlier. Staff are finalizing an amended and restated project agreement, revised technical requirements and DNC contracts for lender review. Counsel said lenders are already engaged with the developer and a short turnaround on approvals is expected; the board will likely be asked in October to formally approve the revised settlement agreement and related project-agreement revisions.
The TDRB update was provided for transparency and no board vote was required. Staff indicated they will continue to brief the board as agreement documents are finalized and submitted to lenders.
