The Town of Lake Clark Shores Code Enforcement Board on Sept. 25 continued a violation hearing for a driveway in disrepair at 1416 Arabian Road East after the homeowner said she needs time to save money for repairs.
Code Enforcement Officer Eric Rich Wagon told the board a notice of violation was issued July 30, 2025 under town code section 34-19(9)(b) for an aging asphalt driveway showing cracking and surface breakdown. Wagon recommended 90 days to comply; the homeowner asked for time to save and said she had just used limited savings to address a separate overgrown-property violation.
Homeowner Susan E. Downing introduced herself to the board and said she is on Social Security and must save to cover driveway repairs and upcoming insurance and property-tax bills: “I'm on Social Security. Mhmm. So I'm going to need time to save up the I don't know how much it's going to cost, but I need time to save up the money.” Wagon and board members discussed the repair as a sealing treatment using materials sold at home-improvement stores as an interim measure to slow deterioration.
Board members agreed to continue the matter to the board's next meeting on Oct. 21, 2025 and requested that Downing bring written estimates of repair costs to that meeting. The transcript records the motion to continue and that the motion carried; the board did not enter a finding of violation at this hearing but explicitly required the owner to present cost estimates at the next meeting.
Discussion vs. decision: the board's formal action was to continue the violation hearing to Oct. 21, 2025 and request estimates; no fine or compliance finding was entered at this meeting. Code enforcement staff offered to provide the homeowner with pricing contacts and to follow up.
Clarifying details: the original notice of violation was issued July 30, 2025; the code section cited by the officer is 34-19(9)(b). Wagon indicated the sealant product is sold in five-gallon buckets and is a temporary mitigation rather than a permanent repair; staff offered to share vendor pricing with the homeowner.
