The Town of Lake Clark Shores Code Enforcement Board on Sept. 25 found FVJ Properties LLC in violation for a dirty driveway at 7003 Pine Tree Lane and ordered the respondent to comply with town code by Oct. 21, 2025 or face potential daily fines.

Code Enforcement Officer Eric Rich Wagon said a notice of violation was issued Aug. 15, 2025 under town code section 34-19(9)(b), and a notice of hearing was posted and mailed on Sept. 12. Wagon told the board he has had no contact with the property owners and that the property appears to be a rental; he also reported the property is listed for sale for $1,100,000 and has visible lakeside improvements that staff suspect may have been done on weekends, possibly without permits.

Wagon confirmed notices were mailed to the owner’s address on the Palm Beach County property appraiser as 443 Denison Drive, West Mifflin, Pennsylvania 15122. Wagon said he has not received any response from the owner and recommended permitting time to comply; several board members expressed concern that the owner has not engaged with staff.

Vice chair Gerard Sanchez moved that the board find the respondents in violation of Town Code §34-19(9)(b) and order compliance on or before Oct. 21, 2025. Sanchez’s motion set a potential civil fine “not to exceed $50 per day” for failure to comply and scheduled a fine-assessment hearing for Oct. 21, 2025, if necessary. The motion carried.

Board members discussed contacting the property's listing agent or following up if a lien search is requested during a sale; Code Enforcement Officer Wagon said he could reach out to a listing agent if board members provided contact information. The board also noted the practical issue that if a property sells and a buyer does not discover a recorded violation, liability can shift to the new owner until the lien or code action is recorded.

Discussion vs. decision: the board made a formal finding of violation and established a compliance date; staff were directed to attempt further contact and accept assistance from board members to reach the listing agent.
