The Town of Lakeville Zoning Board of Appeals approved a petition from Derek Maxey to allow the maximum aggregate building size at 55 Long Point Road to exceed the local 1,000-square-foot limit.
Maxey told the board he had applied for and partially executed a foundation permit in July 2024, then the town bylaw changed to a 1,000-square-foot cap on aggregate building size. He said the foundation was already in place and he came before the board to regularize the structure: "The foundation's actually already in because I had started this," he said. The planning board sent a memo saying it had no comments on the petition.
During discussion, Maxey said he plans to use an upper story primarily for storage and that any accessory dwelling unit (ADU) would be less than 900 square feet. Board members asked whether the proposed structure would be connected to the existing house; Maxey said connecting the new structure to the house would avoid the need for the special permit but he preferred not to make that connection. He also said utilities (water and septic) had been roughed in and the plumbing inspector already inspected the site.
The applicant described the proposed garage footprint as 36 by 60 feet; the board and applicant discussed square footage calculations during the meeting and the final measurements referenced in the motion recorded in the transcript amounted to 2,160 square feet. A member moved to grant the permit; the board voted verbally and the chair said, "Motion carries unanimous."
The board noted that, even with the special permit, standard building-permit review, inspections and any required approvals remain in force. The transcript records no formal objections from neighbors present.
